Important: Williamson Run Call to Action -- October 21



Please review the attached call to action flyer created by the Williamson Run 96th Street/Tyner Woods Committee. Further, please attend the Carmel Plan Commission meeting on Tuesday, October 21, 2014 at 6:00pm at the Carmel City Hall.  Your presence is important to Williamson Run!  The more people we have at the meeting the better.

Carmel Clay Plan Commission Meeting

Mark your calendar!  At the October 21st Carmel Clay Plan Commission Meeting the developer proposing to build a high density apartment complex in the north parcel of Tyner Woods will be seeking permission to move forward. It is important to have a strong showing from the neighborhood so that we can minimize the impact of this new development on Williamsrun.

This is a public meeting from 6:00 to 8:00pm. Generally, speaking citizens can provide public comment at such meetings.  More information will be coming -- the purpose of this communication is to simply ask that you mark your calendar.

An affiliate of Butler Automotive Group is asking Carmel for a zoning change that would clear the way for a 235-unit apartment complex just north of an under-construction Hyundai dealership at 96th Street and Randall Drive.

Property owner 4148 96th LLC wants to classify the 20-acre parcel—now zoned for business uses—as a planned unit development, allowing for project-specific use and development standards.

Plans call for keeping the southern half of the property commercial, with two out lots flanking the 37,000-square-foot dealership along 96th. The northern 9.3 acres would be apartments.

A development plan prepared by Carmel-based multifamily developer CRG Residential shows three three-story buildings with one- and two-bedroom apartments, plus a clubhouse and recreation area.

Apartments would range in size from about 775 square feet to 1,200 square feet. About 100 units would have first-floor garages.

The developer also has proposed a 50-foot-wide “tree preservation area” along the northern property line to provide a buffer between the apartments and the existing Williamson Run single-family neighborhood.

A 10-foot multiuse path would run along 96th Street to the south.

The city of Carmel is realigning Randall Drive to connect with an existing traffic signal at the entrance to the HHGregg store across the street.

Apartment construction has been on the rise nationally, and the northern suburbs have drawn plenty of interest from developers. As IBJ reported in July, about 2,000 units are under construction north of 96th Street, and another 3,500 have at least preliminary approval. More than 2,000 of the planned units are in Carmel.

Public Hearing for Sign Variance

The Butler Hyundai Group is currently seeking a variance to allow more signs for the dealership than are allowed by city ordinance.  A public hearing on the matter is schedule for May 28th at 6pm at One Civic Center.  We are encouraging homeowners to attend.  Board members will also be in attendance.  The variances they are seeking involve additional signage that will face both 96th Street and Randall Drive.  The size of the signs and number of additional signs being requested are not known.

Also, to keep the lines of communication open, the Board has requested a meeting with the developer to learn if there are any serious discussions underway regarding the two outlots on 96th Street, as well as the north parcel that abuts the neighborhood.  We will keep everyone updated as soon as we learn anything new.

The next step in the development of Tyner Woods will happen on Wednesday, March 6th @ 6pm in the Caucus Room (same area as the meeting on Feb 19th – see flyer).  A small working group has met with the developer and there has been discussion and negotiations.  The meeting on March 6th  is a formal negotiation with the developer with the planning commission board.  We need your support and presence to have a similar showing as we had on Feb 19th.  It is extremely important that we continue to have a strong neighborhood attendance.  Please refer to the flyer on the times and the message that we are continuing to pursue.

CARMEL — Another gas station battle is brewing in Carmel — and this time it’s in an area that is already heavily commercialized.

An organized group of 172 homeowners in the Williamson Run subdivision, which sits north of 96th Street, wants a commitment from the developer of a new auto dealership that he will not build a 24-hour gas station.

The development is a new Butler Hyundai dealership planned for the northwest corner of 96th and Randall Road which feeds into the southern entrance to Williamson Run. The land already is zoned commercial.

Neighbors are worried that one of the outlots along 96th Street will be used for a gas station. They plan to voice their frustrations Tuesday night at the Carmel Plan Commission.

“We, in Williamson Run, have reached out to be engaged with the process of the development of the 19 acres of Tyner Woods and have met multiple times with the developer to express feedback on the developer’s proposals,” said David Frische, a spokesman for the neighborhood, in a prepared statement.

“Unfortunately, the developer has not been willing to provide any assurance that our concerns will be addressed.”

Jim Adams of Carmel-based Secure Development Inc., developer of the 96th Street property, said he is working on a response to the concerns raised by the homeowners, but he’s not sure all will be addressed in a way they want.

“We understand their concerns, we have talked to them repeatedly and I am sure we will continue to do that,” said Adams. “But we are not in full agreement on all of their points.”

The neighbors are wanting the same kind of assurances they fought for and won on an adjacent property to the east. Those assurances not only prevent a 24/7 gas station, but also prevents a fast-food restaurant or any other 24-hour business.

This new battle comes after another battle five miles to the north at 146th and Gray Road. Neighbors there were upset over similar plans for a 24/7 gas station. Their loud cries against that plan convinced the owner of the gas station to pull the plans and move the project further east toward the White River.

Carmel Neighborhood to Fight Developer’s Plans for Tyner Woods

February 14, 2013

(Carmel, Indiana) – The 172 Carmel homeowners in Williamson Run plan to fight a proposed development on the 19 wooded acres of Tyner Woods, located at 96th Street and Randall Drive, when the issue goes before the Carmel Planning Commission on February 19th at 6pm.

“We, in Williamson Run, have reached out to be engaged with the process of the development of the 19 acres of Tyner Woods and have met multiple times with the developer to express feedback on the developer’s proposals.  Unfortunately, the developer has not been willing to provide any assurance that our concerns will be addressed,” said David Frische a neighborhood spokesman.

The neighborhood is asking for assurances that the development will not include a 24/7 gas station or fast food restaurant, as per the precedents that were put in place several years ago on the land directly across from Tyner Woods on the east side of Randall Drive.  The precedents that were put in place several years ago, which were agreed upon by the Planning Commission, stipulated that no gas station, fast food restaurant, or 24-hour business be allowed to operate on that land, because it would greatly decrease the property values of the neighborhood.

The Carmel Planning Commission will address the issue on Tuesday, February 19th at 6pm at 1 Civic Square.  A very large turnout is expected.

Tyner Woods -- Carmel Planning Committee

Williamson Run Homeowners,

The WR committee monitoring the development of the property adjacent to the south side of the WR neighborhood has prepared a response  (See Below) to the developers plans and have submitted this response to the Carmel Planning Committee.

The WR committee is inviting ALL homeowners to attend a Question and Answer session regarding the 96th development this coming Tuesday, February 12, 2013, at 6:30 p.m. in the neighborhood clubhouse.   Please plan to attend this important meeting to find out how this new development may impact your neighborhood.

Dear Carmel Planning Commission,

This letter represents the 172 households of Williamson Run.  In it, we express our thoughts and recommendations pertaining to the development of the 19 acres of Tyner Woods at the Northwest corner of 96th Street and Randall Drive in Carmel, IN.

This development concerns the West side of Randall Drive which constitutes the southern, direct entrance and border of our neighborhood.  We do not support the development in its current state.

We have been in touch and have met with the representative of Carmel since January 2012, in our attempt to be pro-active and cooperative with this process.  We have initiated meetings with developers of the property and representatives of the Butler group.  At each of those 2 meetings, we have expressed our willingness to cooperate with the developer within the parameters that already exist for the AutoMall and the office/retail development on the East side of Randall Drive (see attached covenants).

These covenants and precedents have been supported, and in one or more occasions, been enforced by the Carmel Planning Commission when variances have been sought by developers.  At this time, we have had no assurances or acknowledgment from the developer that they recognize or are willing to follow the same, reasonable approach to managing the impact their development will have on Williamson Run and Randall Drive, the southern entrances to our neighborhood.

These covenants represent a good middle ground between the goal of preserving residential property values and the need to allow for the growth of commercial business concerns where property is adjacent to established Carmel neighborhoods and homeowners.  We have been informed by the developer that two out-lots and the North portion of the property immediately adjacent to our community are well suited for an additional car dealership, fast food, gas station or auto-body shop and that they would entertain selling those portions of Tyner Woods for those types of uses.  The covenants do not support these types of businesses.

Our hope is that the Carmel Planning Commission will require the developer to abide by the covenants that have been established for the East side of Randall Drive – as they set a precedent for maintaining a cooperative relationship between residential and commercial concerns – and in fact, have been enforced for development of exactly the same type of businesses proposed by the Butler Group.

We’d like support from the planning commission in creating a sufficient “Buffer Zone” between the development and our homes.  Ultimately, we hope to reassure homeowners in Williamson Run that we have the support of the Carmel Planning Commission in requiring reasonable accommodation by the parties representing the commercial business interests to minimize the negative impact their development has where our homes and neighborhood are directly impacted.

We have been through this process before – when the East side of Randall drive was developed. We compromised at that time and came to an agreement with the developer. We hope to come to the same type of conclusion here.
